We can register your trade mark in most regions of the world. A trademark is any word, phrase, shape, design, color, sound or even smell that identifies and distinguishes one party’s goods or services from those of others. There are benefits to registering the trade-mark. For example, a company can ask Customs and Border Patrol to seize a competitor’s items if they violate a registered trademark. A registered trademark holder is also entitled to statutory damages and injunctions against an infringer.
The Trade Mark Authority does not accept every application to register a trademark. First, a search must be made for competing marks, since the Trade Mark Authority does not want to register a mark used by someone else first. Secondly, some trademarks are not allowed. After an application is filed, the Trade Mark Authority sometimes initiates an “office action” questioning the claim. Competitors are offered an opportunity to oppose the registration application.
